Internet Banking Terms & Conditions

IMPORTANT: The Customer Must Read these Terms and Conditions carefully before using the services by registering to use the services. The customer shall be deemed to have accepted and be bound by all these terms and conditions.

  • About these terms and conditions

    These terms and conditions apply to AB Direct Internet Banking Services for AB Bank Limited (ABBL). These Terms and Conditions operate in conjunction with the terms and conditions applicable to Account (s) the customer access using these services including the opening of any new accounts. If there is an inconsistency, these terms and conditions prevail.

    Please read these terms and conditions before using these services. If the customer does not understand any part of them, or if the customer has any questions, please speak with a staff member at any ABBL branch or ABBL Call Center number 16207 or at+88 096789 16207.

  • Defined Terms

    Customer

    "Customer" means the account holder

    Account(s)

    "Account(s)" means account(s) the customer have with ABBL operable through its branches in Bangladesh, which ABBL has determined is accessible by the services, including any new accounts opened.

    Account Holder

    "Account Holder" means a person who has entered into a contract with ABBL for the services who has an account in his/her own name or a joint account in respect of which ABBL may act on instructions of any one or more of the joint account holders.

    BDT

    "BDT" means Bangladeshi Taka

    ABBL

    "ABBL" means ABBL Limited having its head office at BCIC Bhaban, 30-31 Dilkusha C/A Dhaka-1000, and Dhaka, Bangladesh operating through its branch in Bangladesh.

    Instruction

    "Instruction" means any request or order to ABBL which is affected through the services by use of a user ID, memorable answer and password.

    Internet banking Services

    "Internet banking Services" means the services that ABBL makes available through the internet network to enable the electronics receipt and transmission of information and instructions (including relation to an account).

    PIN

    "PIN" means the customers personal Identification number supplied to the customer by ABBL for accessing the internet Banking Services. Customer will use the PIN for doing transaction. The facility will be available soon.

    Password

    "Password" is the 6-12 digit characters alpha-numeric identification number. The initial "Password" will be generated by ABBL and will be changed at the time of customer's first log on to internet banking services. The new "Password" in alpha numeric passes word.

    Services

    "Services" means the personal internet banking services

    User

    User "User" refers to a customer of ABBL and/or of the Affiliate of ABBL , authorized to use Internet Banking or a person requesting the Internet Banking. In case of the User being a minor, the guardian of such minor shall be permitted to use Internet Banking.

    Personal Information

    Personal Information "Personal Information" refers to the information provided by the User to ABBL

    Website

    Website "Website" refers to the website owned, established and maintained by ABBL located at the URL www.abbl.com

    Terms

    "Terms" mean these terms and conditions, as amended from time to time.

  • Acceptance

    When the customers use the services, the customer accepts these terms. If the customer has previously used the services, the customer's first use of the services after publication of these terms indicates the customer's acceptance of them.

  • Using the Services

    These services can be used for obtaining the balance of any account, view the customers accounts, make standing order payments in relation to any account and update the customers personal details and the customers correspondence address held by ABBL for customers account.

    Make a payment transfer from any account to another account with ABBL or with any other scheduled bank, which is a member for Bangladesh Electronic Fund Transfer Network (BEFTN), within Bangladesh.

  • Secure E Mail Massages

    • a. If we make this facility available to the customer, the customer may send us and we may send the customer secure e-massages over the internet banking services.

    • If the customer sends us a massage we will aim to respond to the customer within two working days by email or by telephone as confirmation of receipt of the customer's message. If this is not possible or we are not willing to answer the customers query or comply with customers request within this timescale or all we will aim to let customer know this within two working days. No request will be implemented until we have first sent the customer a message as confirmation. Please be aware that once the customer has sent request we may not be able to reverse it before it implemented.

    • The Customer must not send us messages

      • Under no circumstances should any message sent by us be construed as an offer to provide a product of service to the customer on particular terms or at all. All products and services are subjected to status and terms and conditions

      • Which require immediate attention (Please telephone us instead)

      • Which are requests of transactional nature e.g. share dealing or fund management instructions

      • Reporting the loss or stolen of cheques and /or cheques or credit cards (Please use telephone instead)

      • Which are offensive, frivolous or otherwise inappropriate. In the Customer do so we may at our absolute discretion remove the "E Mail" facility or terminate the customer's use of the services in accordance with the terms and conditions of this agreement

    • Under no circumstances should any message sent by us be construed as an offer to provide a product of service to the customer on particular terms or at all. All products and services are subjected to status and terms and conditions

  • Customers ID, Password and Security Procedures

    Upon becoming an internet Banking Customer, ABBL will provide the customer with unique identification ("User name") and a temporary Pass word ("Password") which all ways the customers access to the customers account information. Use of the password assigned to the customer will indicate to ABBL customer's acceptance of the terms and conditions governing customers account (s) and this internet banking agreement.

    Once the customer has registered with ABBL internet banking he/she must provide us with identity details before ABBL will allow him/her to use the services for the first time. Customer must enter identity details immediately after signing in, so ABBL can indentify the customer. Every time the customer uses ABBL Internet Banking he/she must give user name, the customer's password; and the answer to an additional security question. Once logged on through valid password the system will not request for any further authorization and it stays valid until the customer log off. Every internet banking operation, including but not limited to accessing account information, making transfers, giving transfer related instructions, initiated after entering the correct password is deemed as initiated by the customer

    If customer's password is lost or stolen or is known by another individual, customer must notify ABBL immediately. Failure to notify ABBL promptly could result in lost of funds. ABBL may provide to the police or any prosecuting authority any information they need if ABBL think it will them to find out if someone else is using the customers username, password or any of the additional security details. ABBL may keep any e-mails sent to or form ABBL. ABBL do this to check what was written and also to help train the staff

    If ABBL thinks that

    • Someone ells is trying to use ABBL internet banking for the customers accounts;

    • The wrong user name, password or any of the customer's additional security details has been used for any account.

    • The Customer or someone else is using ABBL internet banking illegally;

    • The Customer is not keeping to these conditions or the conditions of any customers accounts;

    • Customer's username, password or any of the customer's additional security details might be known or used by someone else.

    ABBL reserves the right to prevent customers access to internet banking should ABBL have reason to believe the confidentiality of customers password has been compromise

    If the customer is a victim of fraud through ABBL internet banking, ABBL shall reimburse the customer in full provided such fraudulent activity is proven in the court of law by the customer. Unless the customer is a victim of fraud, he. she responsible for all instructions and other information sent using his/her username, password or additional security details, customer is responsible for maintaining the confidentiality of customers password and any breach of confidentiality shall promptly be reported to ABBL.

    Customer understands that ABBL has implemented a security procedure for the purpose of verifying the authenticity of the instructions transmitted to ABBL by customers ("instructions"), and not for the purposes of detecting errors in such instructions. Customer agrees that this procedure constitutes a commercially reasonable method of providing security against unauthorized instructions. Customers agrees to be bound by any instructions issued by customers password and received and verified by ABBL in accordance with such security procedure, and customers shall indemnify and hold ABBL harmless from and against any loss suffered or liability incurred by, arising from, the execution of instructions in good faith and in compliance with such security procedure.

  • Computer Equipment and Software

    Customer is solely responsible for the maintained, installations and operation of customer's computer and for the software used in accessing internet banking and ABBL. Shall not be responsible for any errors, deletions or failures that occur as result of any malfunction of customers computer of software, nor will ABBL be responsible for any computers virus that affects customers computers or the software while using internet banking, or by accessing internet banking through the world wide web (WWW). Customer agree that ABBL shall not be liable for any indirect, incidental or consequential costs, expenses or damages (including lost savings or profit, lost data. Business interruption or attorneys fees)

  • Account Requirements

    To subscribe to internet banking, customer must maintain at least one current & savings account. Internet banking will allow customers to access more than one account. ABBL reserves the right to refuse to open an account or to deny customer the ability to access the internet banking, or to limit access or to revoke a customer's access to internet banking without advance notice to customers

  • Maintenance of Sufficient Balance

    The User shall ensure that there are sufficient funds (or prearranged credit facilities) in any Account for transactions through the Internet Banking, and ABBL shall not be liable for any consequences arising out of its failure to carry out the instructions due to inadequacy of funds and/or credit facilities provided always that ABBL shall at its sole discretion, be entitled to carry out the instructions notwithstanding such inadequacy without seeking the prior approval from or notice to the User and the User shall be responsible to repay with interest the resulting overdraft, advance or credit thereby created and for all related to costs and charges.

    ABBL may, at its discretion, levy penal charges for non-maintenance of the minimum balance. In addition to the minimum balance stipulation ABBL may service charges for use of Internet Banking which will be notified by ABBL to the User from time to time in the manner deemed fit to the ABBL. Any change in such service charges will also be notified to the user in the manner deemed fit to the ABBL. The User authorizes ABBL to recover all charges related to Internet Banking as determined by ABBL from time to time by debiting one of the Accounts

    ABBL may withdraw the provision of Internet Banking, wholly or partly, if at any time the amount of deposit falls short of the required minimum as aforesaid and / or if the service charges remain unpaid, without giving any further notice to the User and / or without incurring any liability or responsibility whatsoever by reason of such withdrawal.

  • Funds Transfer Through Internet Banking

    11.1

    The User accepts that he will be responsible for keying in the correct account number for the fund transfer request. In no case, ABBL will be held liable for any erroneous transactions incurred arising out of or relating to the User entering wrong account numbers.

    11.2

    The User shall not use or attempt to use the Internet Banking for funds transfer through e Cheques without sufficient funds in the relative Account or without a pre-existing arrangement with ABBL for the grant of an overdraft. ABBL will endeavour to effect funds transfer transaction received through Internet Banking subject to availability of sufficient funds in the Account. ABBL shall specify from time to time the limit for carrying out various kinds of funds transfer or any other services through Internet Banking. The said facility will be provided in accordance with the arrangement between ABBL and the affiliates and as per conditions specified by ABBL from time to time.

    11.3

    ABBL shall not be liable for any omission to make all or any of the payments or for late payments due to circumstances beyond its reasonable control including non-confirmation of Payee Registration. ABBL reserves the right to charge the User for the use of funds transfer through eCheques by giving due notice on the website about such charges

    11.4

    If funds transfer is made available to the User, it may be used for transfer of funds from Account to other accounts belonging to third parties maintained at ABBL and/or at any other Bank which falls under the network of [Bangladesh Bank Electronic Fund Transfer] system

  • Electronic Mail

    Customer may contact ABBL via email for general, non-urgent communications. As regular email is not secured, no sensitive personal information should be transmitted through e-mail. ABBL will not take any responsibility if any e mail sent by a customer falls in the hands of a non-recipient

  • Reporting Unauthorized Operations and Error Resolution

    If the Customer believes unauthorized operations are being made from customers account, customer should change the pass word immediately and notify ABBL instantly. If customer feels that any statement is wrong of whishes to have more information about a transfer listed on a statement, he/she should contact ABBL in writing or over telephone

    ABBL must hear back from customer within ten (10) business days after problem of errors appeared. When customer contact ABBL

    • Should inform in writing name and account number (should not mention customers password).

    • Should describe the error to the transfer, customers is unsure about and explained clearly why customer believes it is an error or why customer seeks information.

    ABBL will inform customer the results of ABBL's investigation within 10 (ten) business days on receipt of the customers notification and will the correct error (if any) promptly. If ABBL needs more time to investigate, it will inform the customer accordingly and may take up to 90 (ninety days)

  • Fees

    The usage fees for internet banking and or will automatically deducted from customers account. Customer may also be assessed a fee for certain usage. Fees will be changed as per banks policy. Please refer to ABBL's fee schedule for specific fee information. Fees may be deducted from customers account without prior notice to debit the fee from customers account whenever the fees amount is available

  • Customers Responsibility

    Customers shall be responsible for all operations authorized through internet banking. The customer shall be responsible for the proper and authorized use, confidentiality and security of the pass words for ABBL website access to each account and take every possible care to prevent unauthorized use of the password for the account

    The Customer acknowledges that the password are only for verification of authenticity of communications made in the name of the customers through ABBLwebsite access to the account, and not for the purpose of detecting errors in communications and any such communications shall be deemed to those of the customers. The Customer shall be responsible for all instructions initiated or originating by use of the password.

    The customer irrevocably authorizes ABBL

    • To act on all instructions given or apparently given through ABBL website access to an account in the name of the customer

    If the customer gives instructions contrary of these conditions or otherwise, ABBL may at its discretion without advance notice to the customer and without affecting other rights of ABBL

    • Refuse those instructions

    • Suspends or stops access to the account for any period of time

    Customer will not be held responsible for any instructions or information sent after He/she has told ABBL that someone knows the Customers password or additional security details or has used any of them to access ABBL internet banking Customer is advised to take printouts of account statement at frequent intervals for reconciliation purpose

  • Applicable Law

    This Agreement is subjected to the provisions of all applicable operating circulars of Bangladesh Bank, ABBL and any other applicable previsions of laws of the land. This agreement shall be binding upon and inure to the benefit of the parties hereto and their respective legal representatives

  • Anti money laundering

    Customer agrees and confirms that he/she/they will not use these facilities for money laundering or violate any law of the land related to money laundering. ABBLreserve that right to ask fro clarification/information from the customers on any internet banking related information and the customer would be required to response in writing to such queries within 7 working days

    • Any conversion rate of any foreign currency shown is only for customer's convenience. It cannot be taken as price quote from the banks end.

    • Tools that customers may have access to through banking (such as loan calculation) are provided fro customer convenience, but are not guaranteed to be error free.

  • ABBL's Responsibilities

    ABBL shall be responsible for performing services expressly provide fro this agreement, and shall not be liable fro nay error of delay so long as ABBL has acted in accordance with the terms and conditions hereof. ABBL shall not be liable of customer does not have sufficient funds in a designated account or the account is closed

    ABBL shall not be liable if customer has not given ABBL complete, correct or current transfer or payments instructions of if customers have not followed proper instructions given through internet banking or software used. ABBL shall not be responsible for any loss, damage liability or claim arising, directly from any error, delay or failure in performance of any of its obligations hereunder which is caused BT fire or other natural disaster, strike, civil unrest, any incompatibility of communications facilities or any other circumstances beyond the control of ABBL

    ABBL do not accept responsibility from any loss, the customer or anybody else may suffer because any instructions or informational the customer send ABBL are sent in error, fail to reach ABBL or are distorted unless the customer has been the victim of fraud.

    Customer agrees that, expects as expressly stated herein, there is no warranty of merchantability, no warranty of fitness for a particular purpose and no warranty of any kind, express or implied, regarding any aspect of internet banking

  • Severability

    If any provision of the agreement is found to be invalid or unenforceable under applicable law, said provision shall be ineffective to the extent of such invalidity only, without affecting the remaining provisions of this agreement.

  • Amendment

    ABBL may change these conditions of the agreement for any reason by giving the customer written notice or by publishing the change on the web site

    ABBL may send all written notices to the customer at last e-mail address provided by the customer. The customer must send all written notices to the customer at last e-mail address provided by the customer. The Customer must inform immediately after changing their e-mail address (he/she can do so online), to make sure that ABBL has their current email address at all times. This agreement may be amended at any time by ABBL and the revised information will be required to abide by these changes for future operations

  • Wavier

    ABBL may waive any tern or provision of this agreement at any time or time to time, but any such wavier shall not constitute a wavier of the term or provision in the future. No waiver by either party on any breach or default on any provision herein contained by the other party, whether subsequently performed or not, shall be constructed as a waiver of any succeeding breach of the same or any other provision. Nor shall any neglected. Forbearance, or delay in the enforcement thereof shall be deemed to constitute a waiver any of rights under the provisions of the agreement unless such wavier is in writing and executed by the party not breach

  • Disclaimer of Warranties

    The User expressly agrees that use of the Website is at its sole risk. The Website is provided on an "as is" and "as available" basis

    Except as warranted in the Terms, ABBL expressly disclaims all warranties of any kind, whether express or implied or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, data accuracy and completeness, and any warranties relating to non-infringement in Internet Banking

    ABBL does not warrant that access to the Website and Internet Banking shall be uninterrupted, timely, secure, or error free nor does it make any warranty as to the results that may be obtained from the Website or use, accuracy or reliability of Internet Banking.

    ABBL will not be liable for any virus that may enter the User's system as a result of the User using Internet Banking. ABBL does not guarantee to the User or any other third party that Internet Banking would be virus free

  • Indemnity

    In consideration of ABBL providing the User the Internet Banking, the User shall, at his own expense, indemnify and hold AB Bank, its directors and employees, representatives, agents and/or the Affiliates, as the case may be, indemnified against all losses and expenses on full indemnity basis which ABBL may incur, sustain, suffer or is likely to suffer in connection with ABBL or Affiliates' execution of the User's instructions and against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses as a consequence or by reason of providing a service through Internet Banking for any action taken or omitted to be taken by ABBL and /or the Affiliates, its officers, employees or agents, on the instructions of the User. The User will pay ABBL and /or the Affiliates such amount as may be determined by ABBL and/or the Affiliates to be sufficient to indemnify it against any such, loss or expenses even though they may not have arisen or are contingent in nature

    Further, the User agrees, at its own expense, to indemnify, defend and hold harmless ABBL , its directors and employees, representatives, agents, and its Affiliates against any claim, suit, action or other proceeding brought against ABBL , its directors and employees, representatives, agents, and Affiliates by a third party, to the extent that such claim, suit, action of other proceeding brought against ABBL , its directors and employees, representatives, agents, and Affiliates is based on or arises in connection with the user of Internet Banking with reference to

    A violation of the Terms contained herein by the User; any deletions, additions, insertions or alterations to, or any unauthorized use of, Internet Banking by the User; any misrepresentation or breach of representation or warranty made by the User contained herein; or any breach of any covenant or obligation to be performed by the User hereunder

    The User agrees to pay any and all costs, damages and expenses, including, but not limited to, reasonable attorneys' fees and costs awarded against it or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim.

    The User hereby agrees that under no circumstances, ABBL's aggregate liability for claims relating to Internet Banking, whether for breach of in tort (including but not limited to negligence) shall be limited to the transaction charges/fees or consideration paid by the User within the previous twelve (12) months for Internet Banking, excluding any amount paid towards transactions.

  • Assignment

    ABBL may assign the rights and delegate the duties under this agreement to any present or future, directly or indirectly, affiliated company or to any third party for performance

  • Termination

    Either party may terminate this agreement by giving 15 days notice to the other party. Any operation made within these 15 days should be deemed to have been done by the customer. If ABBL terminates customer's access to internet banking it reserves the right to immediately stop making transfers or payments from customers account (s) including those customers previously authorized.
